MAANLIG SAFARI ("the tour operator", "we", "us", or "our")
Effective Date: 20th April 2025
1. Acceptance of Terms
By booking a safari with Maanlig Safari, you ("the Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including our strict No-Refund Policy. These terms constitute a legally binding agreement between you and the Company.
2. Booking and Payments
· Booking: A booking is confirmed only upon receipt of payment.
· Payment Methods: We accept payments via Bank Transfer, Card, Mobile Money.
3. Refund Policy
Maanlig Safari operates a strict NO-REFUND policy. This policy applies to all payments, including deposits, partial payments, and full payments.
We incur significant non-recoverable costs well in advance of your tour, including but not limited to:
· Permits and park fees paid
· Accommodation deposits and guarantees.
· Vehicle and guide reservations.
· Guide salaries
· Purchases of other third-party services.
Therefore, all monies paid to us are non-refundable. This policy applies to, but is not limited to, cancellations due to:
· Change of personal plans or circumstances.
· Illness or personal emergencies (we strongly recommend travel insurance).
· Perceived political instability, safety concerns, or fear of disease outbreaks.
· Flight delays or cancellations preventing your arrival.
· Any other reason beyond or within the Client's control.
4. Cancellation by the Client
If you cancel your booking, the following will apply, consistent with our No-Refund Policy:
· Cancellation at any time after booking confirmation: you are allowed to create a new booking within 11 months or monies are forfieted.
5. Cancellation or Modification by the Company
· Force Majeure: The Company is not liable for failure to perform its obligations if such failure results from circumstances beyond its reasonable control ("Force Majeure"). This includes acts of God, war, terrorism, government restrictions, significant park closures, natural disasters, or any other event that makes it impossible or unsafe to operate the tour as planned.
· In such cases, the Company will offer a future tour credit for the amount paid, valid for 60 months from the original departure date.
· Low Enrollment/Other Reasons: The Company reserves the right to cancel a tour for any reason (e.g., low enrollment) before the departure date. In this specific scenario only, the Company will offer Clients a choice of:
1. A full transfer to an alternative tour date.
2. A future tour credit.
6. Travel Insurance – MANDATORY
It is a mandatory condition of booking with us that you purchase comprehensive travel insurance. Your policy must, at a minimum, cover:
· Trip cancellation and interruption.
· Emergency medical expenses, evacuation, and repatriation.
· Personal accident and liability.
· Loss of personal baggage and effects.
You must provide proof of adequate insurance before the tour commencement. The Company will not be liable for any costs incurred by you due to your failure to obtain appropriate insurance.
7. Client Responsibilities
· Travel Documents: You are responsible for ensuring you have a valid passport with at least 6 months' validity, the appropriate visa for Uganda, and any required vaccination certificates for example Yellow Fever.
· Health and Fitness: You must disclose any pre-existing medical conditions and ensure you are physically and mentally fit for the tour activities.
· Conduct: You agree to comply with the laws of Uganda and follow the instructions of the tour guide. Maanlig Safari will terminate your tour, without refund, if your behavior is deemed to endanger or negatively impact the group, staff, or wildlife.
8. Limitations of Liability
Maanlig Safari acts as an agent for independent suppliers (hotels, transport providers, etc.). We are not liable for any loss, damage, injury, death, or expense caused by the acts or omissions of these third parties.
9. Assumption of Risk
You acknowledge that adventure travel in East Africa involves inherent risks, including rough road conditions, encounters with wildlife, and remote locations with limited medical facilities. By booking this tour, you voluntarily assume all these risks.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Uganda.
11. Amendments
Maanlig Safari reserves the right to amend these Terms and Conditions at any time. The Terms and Conditions in effect at the time of booking will apply to your tour.
